2. Scope and acceptance
By placing an order with CHA4U, you agree to the terms applicable to your purchase.
Where you purchase as an individual for personal use, the consumer provisions in these terms apply.
Where you purchase for resale, commercial use or business purposes, the business-to-business provisions apply.
If a separate written agreement has been agreed and signed by CHA4U and a business customer, that agreement will take precedence where its terms conflict with these general terms.
Nothing in these terms excludes or limits any consumer rights that cannot legally be excluded.
3. Products and descriptions
We aim to ensure that our product descriptions, photographs, prices, weights and packaging information are accurate.
Tea is a natural agricultural product, and minor variations in colour, aroma, flavour and appearance may occur between batches.
Such natural variations do not affect our obligation to supply products that meet the applicable legal requirements and agreed product description.
Any claims regarding tea origin, ingredients, quality, certifications or health benefits will be made only where appropriately supported.
4. Prices and payment
4.1. All prices will be displayed or communicated before an order is confirmed.
4.2. Applicable taxes, delivery charges and any additional costs will be disclosed before the customer commits to the purchase.
4.3. Payment must be made using an accepted payment method and in accordance with the payment instructions provided by CHA4U.
4.4. An order may be held pending payment confirmation, where this has been clearly communicated.
4.5. For wholesale and business orders, payment deadlines, deposits, credit limits and any agreed credit terms will be confirmed in writing.
4.6. CHA4U reserves the right to correct genuine pricing errors before accepting an order. If an order has already been accepted, we will contact the customer and agree an appropriate resolution rather than impose an undisclosed price change.
5. Orders and order confirmation
5.1. Orders are subject to availability and acceptance by CHA4U.
5.2. Customers are responsible for providing accurate contact, billing and delivery details.
5.3. An order confirmation will be provided through an appropriate channel, such as email, an online order confirmation or written business correspondence.
5.4. For customised gift boxes, bulk orders, special packaging or event orders, the agreed specifications, quantities, prices and delivery arrangements should be confirmed in writing.
5.5. If CHA4U cannot fulfil an accepted order, the customer will be informed and any amount due for the unfulfilled order will be refunded as appropriate.
6. Delivery, collection and risk
6.1. Delivery options, estimated delivery dates and applicable charges will be communicated before the order is finalised.
6.2. Delivery dates are estimates unless a specific date has been expressly agreed as binding.
6.3. Customers must ensure that someone is available to receive the delivery where required.
6.4. If delivery is delayed or a parcel is lost or damaged, customers should contact CHA4U promptly so that the matter can be investigated.
6.5. For consumer purchases, responsibility for loss or damage during delivery will be determined in accordance with applicable law.
6.6. For business orders, delivery, collection, risk and any agreed delivery terms will be set out in the relevant order confirmation or written agreement.
7. Consumer cancellations, returns and refunds
7.1. Customers purchasing online, by telephone, by email or through social media may have statutory cancellation rights, depending on the transaction and any applicable legal exceptions.
7.2. Where the statutory 14-day cancellation right applies, customers may notify CHA4U of their decision to cancel within the applicable period. The relevant period and procedure will be communicated as required by law.
7.3. Where a cancellation right applies, customers must follow the return instructions provided by CHA4U. Return postage costs will be allocated in accordance with applicable law and the information provided before purchase.
7.4. Certain products may fall within statutory exceptions to cancellation rights, including qualifying perishable goods or sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed. These exceptions will only be relied upon where the legal requirements are satisfied.
7.5. Customers should contact CHA4U if an item is faulty, damaged, incorrect, unsafe or not as described. We will assess the issue and provide the remedy required by law.
7.6. Refunds will be processed within the applicable statutory timeframe. Where a customer exercises a statutory cancellation right, any refund of standard delivery charges will be handled in accordance with the applicable rules.
7.7. Nothing in this section affects the consumer’s statutory rights under applicable consumer protection legislation.
8. Business-to-business and wholesale orders
8.1. Wholesale prices, minimum order quantities, product specifications and delivery arrangements will be agreed in writing before supply.
8.2. Unless otherwise agreed, business customers must pay invoices by the due date stated on the invoice or in the written agreement.
8.3. Any deposit, staged payment, credit facility or special pricing arrangement must be agreed in writing.
8.4. Business customers must inspect deliveries within a reasonable time and notify CHA4U promptly of any shortage, visible damage, incorrect item or suspected product defect. This does not remove any rights or remedies available under the applicable contract or law.
8.5. Retailers and distributors are responsible for handling, storing, displaying and selling products in compliance with applicable food-safety, labelling, traceability and other legal requirements relevant to their activities.
8.6. Business customers must not alter product labels, remove required product information or make unauthorised claims about CHA4U products.
8.7. No retailer, distributor or other business partner is granted exclusive selling rights unless this has been expressly agreed in a separate written agreement.
8.8. Where permitted by law and the relevant contract, CHA4U may suspend further supply for overdue invoices after giving appropriate notice.
8.9. Statutory rights and remedies relating to late payment will remain available where applicable.
9. Product quality, ingredients and storage
9.1. Products will be supplied in accordance with their applicable specifications and legal requirements.
9.2. Customers should check the product packaging for ingredients, allergen information, net weight, date marking, storage instructions and preparation guidance, as applicable.
9.3. Tea should generally be stored in a cool, dry place, away from moisture, direct sunlight and strong odours, and in accordance with the instructions on the packaging.
9.4. Customers should not consume a product if its packaging has been compromised or they have a reasonable concern about its safety. They should contact CHA4U with the product and batch details, where available.
9.5. CHA4U will investigate substantiated product-quality or safety concerns and take appropriate action, including any action required by law.
10. Gift boxes and customised products
10.1. Gift boxes and seasonal products may contain combinations of tea, accessories, decorations and other items as described at the time of purchase.
10.2. Any permitted substitution due to availability will be communicated to the customer where it materially affects the agreed order.
10.3. Customised or bulk orders may be subject to specific production timelines, deposits and cancellation arrangements, provided these are communicated and agreed in advance.
10.4. Any restrictions on cancellation or refunds for customised items will apply only to the extent permitted by law.
11. Branding and intellectual property
The CHA4U name, logo, original packaging designs, marketing materials and other intellectual property owned by CHA4U may not be copied, reproduced or commercially used without prior written permission, except where permitted by law.
Purchasing CHA4U products does not transfer ownership of our branding or intellectual property to the customer or business partner.
12. Complaints and customer service
We aim to resolve complaints fairly and promptly.
Customers and business partners should contact CHA4U using the contact details provided above, including the order number, a description of the issue and relevant photographs or batch information where appropriate.
We will review the complaint and communicate the next steps.
13. Limitation of liability
Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by law.
For consumer sales, CHA4U’s obligations and liability will be subject to applicable consumer protection law.
For business-to-business sales, any agreed limitation of liability must be expressly set out in the relevant written agreement and must be legally enforceable.
14. Privacy and personal information
CHA4U will handle customers’ personal information in accordance with applicable data protection legislation and its privacy notice.
Personal information may be used as necessary to process orders, arrange delivery, respond to enquiries and meet legal obligations. Any additional use will be subject to applicable law and the information provided to the customer.
15. Changes to these terms
CHA4U may update these terms from time to time. The applicable terms will be made available to customers before they place an order.
Changes will not retrospectively remove rights already acquired or alter an accepted order without an appropriate legal basis and, where required, the customer’s agreement.
16. Governing law
These terms are intended for UK sales. They will be governed by the law applicable to the relevant transaction, subject to any mandatory legal protections that apply to the customer.
Where appropriate, a separate business agreement may specify the governing law and jurisdiction for that agreement.
